Catalyst for Change: The Law and What to Do When Disagreeing with It

This blog was taken word for word from sa recent discussion I had in an Ethics class regarding what the term "law" stands for. I was pleased with the way it came out, even if I may have strayed from the mark as far as defining what the law stands for.

Good day all, 
            The realm of law has always interested me. One of the aspects of the subject that I find so intriguing is the somewhat fluid relationship counter-cultures can have with the legal system. As I also mentioned in my discussion post, the law is typically born out of societal values. However, these societal values are often governed by the majority. This idea forces some counter-cultures to essentially pick and chose the laws they follow, or at least agree with. In many ways this dissent can also bring about change. One example of this is the idea of civil disobedience brought to the forefront of our culture by Dr. Martin Luther King Jr. King can be paraphrased as stating, “Riots are voice of the silenced.” King himself did not practice violent protests, as he knew that peaceful protests were a revolutionary way to get people’s attention (and backing) in a positive manner. This is captured by Kevelson when she states that it becomes the obligation of citizens to ensure their own rights when an oppressive government has overstepped its bounds (2002). As a result King was able to be a catalyst for change in Civil Rights and in the corresponding federal law.


            Summarily, the law governs the land, but it is clear that in trying times, citizen’s devotion to these laws may wax and wane.

Upgrade: Part II of II


Days passed and Kenny counted them down with glee. Each hour that fell brought him closer to his full potential, to his destiny.  
            He was in the break room at work eating a bologna sandwich and playing a game on his phone that required the matching of like-colored jewels to score points. Kenny liked seeing the shapes and colors line up. He liked seeing order triumph over chaos.  
            “Kenny, Kenny look!”
            Kenny looked up to see a few of his coworkers gawking at the television screen mounted in the corner. One of his colleagues, Vern; a fat man with only a thin wisp of hair smattered over his noggin was hollering his name.
            “Are you seeing this? This nutjob who just got upgraded last week is going on a rampage downtown!”
            On the screen he saw a woman with robotic legs repeatedly kicking an ATM. One kick, two and then three, before she had punched through the ATMs exterior and knocked it from its base. The machine toppled over and crashed to the ground with a thud as its display went dim. The fair-haired woman had a dark green blouse and was red with anger. She had on a tight black skirt that seemed to accentuate the robotic contours of her legs. Peeking out from the skirt were two shiny steel “feet” covered in flimsy matching green pumps. If you listened closely, and could separate the sounds around her you could hear the electronic whir of gears and mechanisms operating within her legs.
            “Insufficient funds! I’ll show you insufficient funds! You piece of shit!”
            In front of the bank, police parted the crowd the woman had attracted and leveled their service weapons. “Stand down ma’am.”
            The woman paid no attention and front kicked the bank’s brick wall with her robotic left foot. As she pulled it away the gears in her leg whined, but the brick bore a noticeable mark as chunks of rubble fell to the sidewalk.
             “Ma’am we need you to calm down!” an officer yelled.
            The woman turned now, finally facing the officers. “Calm down! Don’t you tell me to calm down! You’re just afraid of me!” She walked towards the police, in spite of the fact that their guns were trained on her. As she did this her left foot rolled under her. Machinery somewhere inside snapped, but the woman kept coming, only this time with a severe limp. “No, not afraid of what I am, but afraid of what you aren’t.
            Another warning from the police, “Ma’am if you do not yield we will open fire.”
            The woman didn’t slow in the least.
            “Ma’am this is your final warning!” On the screen the camera’s view pivoted from the police to the woman and quickly back again. Shots rang out as the muzzles of the officer’s weapons lit up.
            The camera feed was terminated and the view was back to the station’s newsroom where a blushing reporter nervously searched for words. “Ladies and gentlemen as you can see this upgraded individual has seemingly…umm…she has been…umm…halted by law enforcement. We will continue to collaborate with authorities to determine if her…umm…mental faculties were at all affected by her upgrade.”
            “Did you see her eyes?” one of the women in front of Kenny asked the room.
            Vern called out, “Definitely bat-shit. Power corrupts, and absolute power corrupts like a lot.”
            “That’s some scary stuff right there man,” offered an older gentleman sitting at the table opposite Kenny.
            “Kenny did I see one of those Astir pamphlets on your desk the other day?” Vern asked, and suddenly the entire room’s eyes were on Kenny.
            Kenny, finally managing to take his eyes from the screen, didn’t seem to notice a large blob of partially chewed bologna leaving his mouth to fall on the table before him.

            A few hours later, Kenny found himself in a bar near work, in a half-assed attempt to relax. The establishment was decorated in the late 70’s and hadn’t seen much in the way of upgrades since then. High back leather-bound bar stools matched the padded leather elbow guard that ran along the bar. Plastic plants and dull orange paint were smattered in every conceivable part of the room. Kenny thought the barroom’s look matched its smell; that of self-loathing.
            As Kenny drank he continued to mull over one idea. He had found it strange that between he and his co-workers had viewed the news broadcast as if they were watching two completely different programs.
            Even as Kenny took a long pull on the beer before him, the news replayed the incident with the woman and the ATM. Following the tape a newscaster addressed the viewers. With a critical look straight into camera the newscaster spoke solemnly. “It seems regarding recipients of Astir upgrades it is not a matter of if they will descend into rage and violence, but when.”
            “Insane, right? If you woulda asked me 20 years ago whether or not I would ever live to see the day when people were walking around with Terminator legs, I woulda said ‘hell no’.” A few stools down from Kenny, the man who had spoke the unsolicited statement did so over an empty rocks glass, and was now looking expectantly to Kenny for commentary.
            Kenny took a breath, his eyes flicked from the television set mounted above the bar to the man a few feet from him. “Have you ever seen Godzilla?”
            The man nodded and simultaneously shook his empty glass at the bartender.
            “You know how the people in those movies are always running around, frantically screaming as they stare up at the monster?” Kenny asked.
            Again, the man nodded.
            “So you can understand what it’s like to be vulnerable, to feel afraid. Something you’ve never seen before just set your whole world view on fire. Something powerful, something you have no control over. But tell me friend, how would you feel if you were Godzilla?”
            Kenny took more than a tiny bit of pleasure from the dumbfounded look on the man’s face, and then rose to leave. He set a few dollars down on the bar, leaving his half finished beer to sweat along with the man.

There's Always a Choice

I’ll start with a bit of a disclaimer: I am no expert on politics. That won’t shock any of you that know me personally as you’ve probably often wondered if I am even aware of the fact that it’s an election year.            Oh, but I am, those tacky signs pinned on every street corner, in every city- they’re a dead giveaway! By the way, I’ll mention that the street corners are appropriate places for those wastes of paper and space.             
                That being said, I have a few things I need to get off my chest, and I’ll try to be as honest (or as “un-politician-like”) as I can as I go through these items.

The Lesser of Two Evils
                First off, we as a country are facing two absolutely abysmal choices for “candidates” from the Republican and Democratic parties this year. On one hand we have a self-serving, greedy, bigot, and on the other we have a self-serving, lying, sellout. It makes you think that we have hardly any choice at all. It makes me sick to my stomach to think that either one could be president.

We Need a Change        
                I’ll admit I was going to vote for Bernie Sanders in the Democratic primary, but unfortunately due to a state law saying I needed to be registered with that party 30 days prior in order to do so, I was barred. That being said, I am a realist, and I didn’t mourn over the fact that he lost the democratic nomination to Mrs. Clinton. At this stage I will neither cry over it, nor entertain inter-party conspiracy theories (although it does make one wonder).
                I say all that, to say this; we need political reform. The delegate/super-delegate system, Electoral College, corporate donations, lack of term limits, and other archaic practices are only in place so that each party doesn’t lose more control than is acceptable at any given time.
                They’ve conditioned you to cheer for your chosen political party like it’s a Super Bowl matchup for the ages. People are more concerned about what side wins or loses than who actually gets anything done once they get elected. Personally, it’s not a matter of popularity, looks or celebrity endorsements with me- I want results!

Agree to Disagree?
                Which brings me to my next point: the donkeys and elephants despise each other, that’s been clear to me since I was a child. Get two guys or gals together; different religion, different backgrounds different education…9 times out of 10 they are usually fine until someone brings up politics. However, we should hold our elected officials to a higher standard. You don’t have to agree on every issue in order to make progress. I was a project manager at a huge corporation for a decade- guess what? I often had to work with colleagues that I didn’t agree with (gasp), even on occasion, those I didn’t like!
                I couldn’t stymie or filibuster them into oblivion because at the end of the day my boss wanted results. If I didn’t have them? Then I imagine my walking papers would’ve been promptly drawn up.
                If you can’t agree on how to solve for a particular issue, at least you can agree it’s a problem facing the nation. My suggestions to our legislators from across the aisles would be to start there. Work together, your ideologies may differ but you can at least agree on a starting point. Be professional, and do the job you were elected to do, rather than the bidding you pledged to your political party.

Thinking it Over
                Now I’ve come to a point where I am certain that I will not be voting for Clinton or Trump come Election Day. Do I just sit at home and drink a beer, eat a few handfuls of Doritos and hope for the best? I don’t think I can manage that. In fact, I’m not sure if I could live with myself over that type of inaction in the face of such mounting peril. The question becomes who then?
                My answer; at this point I don’t know. I am currently looking at the Johnson & Weld ticket, and doing some research to see where they are at on issues. While still politicians, I feel that they may be more results-focused, rather than special interest-focused than our other choices at this stage. This isn’t an endorsement, as I am still currently vetting them as an option. But I know what you’re going to say to that; “A vote for anyone outside of the two major parties is a wasted vote” – if you truly think that, reread what I wrote above about being conditioned- and then reconsider why you think that.*
                See you at the polls…God help us all.

UPDATE
                So I thought it an idea (maybe not a "good" one, but an idea nonetheless) to add an update as we have gotten much closer to election day, and so much has happened since I initially wrote and posted the original blog.
                I felt compelled to address what seems to me to be the main arguments between both democrats and republicans regarding the other party's candidate, and they are: integrity and capability.
                I'll begin with integrity. Let's be honest, both major candidates are less than truthful. Clinton's main detractors point to her mismanagement of classified emails and her utilization of an alleged pay-to-play strategy in regards to her dealings with persons of power and their involvement with the Clinton Foundation, and Benghazi. Those who oppose Trump cry foul regarding his shady business dealings, disparaging remarks about...well pretty much everyone except wealthy white men, grabbing *ahem* things that don't belong to him, and lack of releasing tax returns. Neither candidate is ideal, neither candidate inspire much hope when viewed through a realistic lense.
                Which brings me to my next point around capability. If I am objectively reviewing both candidates behavior and record and see reasons to distrust both, where does that leave me?
                Well to be frank it leaves me with a poor choice. However, with that being said if I am already willing to accept that both candidates lie, or are at least less than truthful on a regular basis, it has to come down to who can get the job done, right? Given Trump's panache for child-like tirades, gross misstatement (or perhaps misunderstanding?) of statistics, and lack of culpability for his own actions / statements, I cannot in good conscious cast a vote for a man who's only possible strength is that he hasn't abused power in a political setting...yet.
                To expand, claiming Trump is anti-establishment and shakes up both the republicans and democrats because he is an outsider with no interest in party pandering or favors might be accurate, but it has become quite clear that Trump is only out for Trump, and if elected I foresee the man taking office and using the country itself to further his business dealings and nothing more. Moreover, I believe that Clinton can and will do what she can to help the disenfranchised in this country, even if she herself profits while doing so.
                 To wrap up, I've already cast my vote via early ballot, and I'll let you use the above diatribe to determine who it went toward. But know this: I can only say I voted for the lesser of 2 (more accurately 4) evils and that realization doesn't make me feel proud this election year.

*I'll add that after researching both the Johnson/ Weld and Stein/ Ajamu policy and platforms I found them both to be at best lacking substance, and at worst ignorant on government structure, operations and processes. But I wanted so badly for them to be robust, and well laid out. Really and truly, I did.

See You in the Funny Papers

Ahh, comic books, that microcosm of literature that somehow manages to work every internet nerd into a steely-eyed, froth-mouth frenzy of rage if one tiny thing is changed about the characters they’ve followed from the time they were old enough to read, up until present day, where they rant with their keyboards via their parents Wi-Fi connection. All the typical things like “You ruined my childhood!” and “This isn’t canon!” and “My mom got me Cool ranch Doritos instead of Nacho cheese!”
                We’ve been seeing changes from both Marvel, as well as DC as they provide their respective universes with a bit more diversity, and even enable writers to start with a new approach to classic heroes in order to attract new fans.
                As of this writing, the latest item that’s filling Marvel’s hate mail (Do people still actually send letters anymore? Or is all internet hate directed via online forums and email?) is their decision to “retire” Tony Stark and replace him with a 15 year old GASP! African-American DOUBLE-GASP! girl! TRIPLE-GASP!   
                Immediately thereafter, all the narrow-minded, stuck in the past, obsolete fan boys (and maybe girls?) scream their collective disapproval, and then shit themselves in disbelief.
                In recent times we’ve also had DCs New 52, and now DC’s Rebirth, along with Marvel creating Marvel Now, and not to mention their efforts at making Miles Morales (the new Spider-Man), female Thor, New Wolverine (X-23) and so on and so forth…and in all these instances at least a segment of the comic fan base became irate and complained endlessly.
                Obviously, I’m writing about this because I have an opinion, and here’s where I’ll tell you what it is…
                …As at least a casual comic book fan since 1992 I think this type of thing is amazing and here’s why:
                As a fan, in many of these heroes’ cases we’ve seen them in action for nearly three-quarters of a century (or more). More or less, every story arc that can be done has been. We’ve seen them beat up every manner of bad guy (or gal), we’ve seen them love and lose, we’ve seen them fight our other favorite heroes, we’ve seen them broken, lose everything, and even die, only to come back as if nothing ever happened. Why on earth would you want to have writers rehash the same story, and cover the same ground that’s been done for decades?
                As a writer (term used loosely, I am a filthy, filthy amateur) rebooting, or retooling these characters provides fertile ground to yield fresh ideas. When you think of Wolverine for instance, it’s a safe bet you know the origin, the experiences, the famous battles and moments of his fictional life. Further, I could argue, due to Wolverine’s personality, you can almost predict (based on circumstance), where the character will end up. But you don’t know X-23’s because they haven’t been written yet! You see what I’m getting at?
                As a capitalist, I can also understand why Marvel in particular can’t just say, well fans want more diversity in their heroes, so let’s create a brand new one. Names like Iron Man, Thor and Spider-Man are more than just household names; they are brands in and of themselves! It could conceivably take years to build up the popularity and name recognition of a new hero or heroine, and why risk that when from a creative perspective it lends itself to produce dynamic ideas that haven’t been done before?
                Personally, some of my favorite books are the ones that never took place in their respective universe’s continuity. Books like Old Man Logan, Marvel Zombies, Deadpool Kills the Marvel Universe are all great because they break the rules of what you might expect from certain characters, settings or origin stories. In other words, I want to see something new!
                In short, to all you naysayers out there: STFU!


                Only after, the new Iron Man (Wo-man?, Girl?? Person???) is released then and only then do I give you permission to whine, piss and moan.

                Actually, no I take that back, we still don’t want to hear your ridiculous opinions, and to be clear no one cares about your childhood.
